Terms of Service

Golden Catalyst LLC (“Golden Catalyst,” “we,” “us,” or “our”) operates Ignite™ Platform, BehaviorStack™, HeartSpark™, MarketSpark™, and related Services. MarketSpark™ is a market intelligence and behavioral analytics application operating within the Ignite™ Platform ecosystem. All Services are provided by Golden Catalyst LLC, a Florida limited liability company.

1. Acceptance of Terms

By accessing or using MarketSpark™ or related Services, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not access or use the Services.

2. Eligibility

You must be at least 18 years old, possess the legal authority to enter into binding agreements, and comply with all applicable laws and regulations.

3. Accounts & Authentication

Certain Services require account registration. Users are responsible for maintaining confidentiality of credentials, safeguarding authentication information, all activity occurring under their accounts, and maintaining accurate account information. MarketSpark™ may utilize centralized authentication or unified account systems provided through Ignite™ Platform. We reserve the right to suspend, restrict, or terminate accounts at our discretion.

4. Acceptable Use

Users agree not to violate laws or regulations, engage in unlawful trading activities, manipulate markets, misuse generated analytics, generate deceptive or harmful content, reverse engineer systems, scrape data or models, overload infrastructure, bypass security measures, impersonate individuals or entities, or misuse AI-generated outputs. Unauthorized use may result in suspension, termination, or legal action.

5. AI-Generated Market Insights

MarketSpark™ may generate behavioral market insights, predictive observations, analytical summaries, probabilistic signals, recommendation-style outputs, educational market commentary, and AI-assisted analytical content. AI-generated outputs may contain inaccuracies, may produce unexpected results, may vary depending on user input, and are probabilistic in nature. Users are solely responsible for evaluating generated outputs, verifying information, exercising independent judgment, and determining whether generated content is appropriate for use.

MarketSpark™ is intended for informational, educational, analytical, productivity, and entertainment purposes only. MarketSpark™ does not provide financial advice, investment advice, tax advice, legal advice, brokerage services, trading guarantees, or licensed financial services.

Golden Catalyst LLC makes no guarantees regarding profitability, trading performance, investment returns, market predictions, predictive accuracy, or financial outcomes. All trading and investment activity involves substantial financial risk. Users are solely responsible for their financial decisions and should consult qualified financial professionals before making investment or trading decisions.

7. Behavioral Intelligence Systems

BehaviorStack™ is a proprietary behavioral intelligence framework developed and operated by Golden Catalyst LLC. BehaviorStack™ technologies may analyze market behavior, contextual signals, interaction patterns, engagement metrics, behavioral tendencies, platform activity, and usage behaviors to improve personalization, analytical relevance, and probabilistic user experiences. These systems are designed to improve analytical experiences and personalization, not to guarantee financial outcomes or investment performance.

8. User Conduct & Responsibility

Users are solely responsible for financial decisions, investment activities, trading actions, analytical interpretations, and use of AI-generated outputs. Users agree not to use MarketSpark™ for unlawful trading, fraud, market manipulation, deceptive conduct, abuse of analytical systems, or violations of securities or financial laws. Golden Catalyst LLC is not responsible for user financial activities or trading decisions.

9. Payments & Subscriptions

Certain Services may require subscriptions, credits, premium access, or usage-based billing. All purchases are final unless otherwise stated. Credits have no cash value, are non-transferable, and may expire. Pricing may change at any time with reasonable notice.

10. Intellectual Property

All platform technology, software, AI systems, behavioral intelligence frameworks, branding, predictive systems, analytical tools, infrastructure, algorithms, and related intellectual property remain the property of Golden Catalyst LLC or its licensors. BehaviorStack™ and Ignite™ are trademarks of Golden Catalyst LLC. Users receive only a limited, revocable, non-transferable license to use the Services in accordance with these Terms.

11. User Content

Users retain ownership of submitted content. By using the Services, users grant Golden Catalyst LLC a limited, non-exclusive, worldwide license to process, analyze, store, transmit, and utilize submitted content solely for operating the Services, generating AI outputs, maintaining functionality, improving systems, maintaining security, and improving user experiences.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN CATALYST LLC DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AND AVAILABILITY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLDEN CATALYST LLC SHALL NOT BE LIABLE FOR INDIRECT DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, TRADING LOSSES, INVESTMENT LOSSES, MARKET LOSSES, OR RELIANCE ON AI-GENERATED OUTPUTS. Use of the Services is at the user’s own discretion and risk.

14. Indemnification

Users agree to indemnify, defend, and hold harmless Golden Catalyst LLC from claims, damages, liabilities, losses, costs, and expenses arising from misuse of the Services, violations of these Terms, unlawful financial activity, user-generated content, trading decisions, or violations of law.

15. Arbitration & Governing Law

These Terms are governed by the laws of the State of Florida, United States. Any disputes arising from the Services shall be resolved through binding arbitration in Florida, except where prohibited by law. Users waive participation in class-action lawsuits or class-wide arbitration.

16. Termination

We may suspend, restrict, or terminate access to the Services at any time, with or without notice, for any reason including violations of these Terms, misuse of the Services, unlawful conduct, security concerns, or operational risks.

17. Changes to These Terms

We may update these Terms periodically. Continued use of the Services after updates constitutes acceptance of the revised Terms.
